Independent Second Opinion on a Major China Dispute

Project legal services

A defined review before deciding whether to sue, appeal, settle or continue.

Discuss this project

When this service fits

For a party facing a significant China-related civil or commercial dispute who needs a fresh assessment of specified decisions. The review asks which issues could change the outcome, what evidence is missing, and how legal merits, procedure, costs and recoverability affect the available options.

What the agreed work can deliver

  • A complete reading of the agreed file, with a document inventory, factual timeline and missing-material list.
  • A written opinion on the defined issues, distinguishing established facts, competing arguments and assumptions.
  • A decision comparison covering litigation, appeal, settlement or other relevant routes, including evidence, cost and enforcement limitations.
  • One decision meeting to explain the opinion, answer questions within scope and identify next steps.

Work in stages

  1. Define the review: confirm the parties, conflict check, specific decision, file scope and actual procedural deadlines.
  2. Review the complete agreed record: identify decisive issues, adverse evidence and material gaps.
  3. Deliver and discuss: provide the written opinion and hold the agreed decision meeting.

Scope and boundaries

An opinion is not a promise of success and does not automatically replace existing counsel. It does not suspend filing, appeal or limitation deadlines, or include representation, filing or service. Urgent procedural work must be separately accepted; it should not wait for a review by default.

How scope and fees are agreed

A defined-scope quotation identifies the questions, proceedings, document volume, languages and one decision meeting. A new case theory, substantial new evidence or additional proceedings requires a scope review.

The law firm accepts the engagement and agrees the scope and fees in writing before substantive work starts. Fees, applicable taxes, expenses, languages, deliverables and any additional work are confirmed in the engagement terms. Sending an enquiry does not itself create an engagement.

General fee information

Documents to prepare

  • The operative judgment, award, notice or proposed claim, with receipt/service dates where relevant.
  • The complete agreed pleadings, evidence, hearing records, prior opinions and significant correspondence.
  • The decision to be made, known asset/enforcement information and any current settlement proposal.

A practical question

Does requesting a second opinion transfer my case to a new lawyer?

No. Independent review is a separately defined service. Any change in representation, communication with existing counsel or procedural action needs its own agreed arrangements and authority.

Discuss this project

For a first enquiry, send the parties’ names, your role, a short outline and any actual deadline. After a conflict check, the document review and proposed work can be scoped. Please agree a suitable channel before sending sensitive case files.
